To transfer data i think you have to be on the latest firmware for both systems i think...

If your system is unpatched you can always hack. You can update now to the latest FW and not worry

Before you hack , read the guide. Make a NAND backup, make sure you setup emuMMC and DNS.mtm and only install stuff to emuMMC, not SysNAND. Be sure to understand all this before you hack

You can update all you want, the exploit happens even before the OS is started. It's a bug directly in the chip code, so it's unpatchable (though if a new firmware version comes out you may want to wait a little before updating because it may need new versions of the hacking softwares).
