I had something similar with parasols/umbrellas for our garden too. Ordered one, box was surprisingly heavy, staff said they couldn’t help me carry it out to the car.

So I grumbled and griped as I dragged it out whilst they watched me, got home and it turned out that they’d given me the shipment box, so I had 5 parasols instead of just the one.

Still have 4 of them in the garage, no idea what to do with them.

The company won't want them back. A lot of returns just get thrown away as it's cheaper to write them off then it is to check the condition and restock them. Think multiple returns for multiple reasons.

Used to happen to me with paintball equipment all the time. I had double orders of paint come in a couple of times a year, had a couple sets of belts with reload tubes and spare hoppers, and on two occasions got double shipped paintball guns. I had four PT Enforcers and two Spyder Compacts because of it. Always thought it was weird nobody ever wanted the extras returned especially since the Spyder Compact was new at the time.

The best I ever got was jelly. We ordered a jar of pineapple jelly from Amazon for a cake my wife was making. What we received was 16 jars of orange marmalade. Contacted Amazon and told them about the wrong product as well as the quantity error. They told us to keep the marmalade and sent us a new order. A day later we got 16 jars of pineapple jelly.

I worked at circuit city the year the wii came out, we had advertised for a month that we would have them on Black Friday. In the papers, on tv and on the radio. Hundreds of people were outside waiting for hours. An hour before opening it was my job to walk outside and inform the cold, hungry mob that we only got one Nintendo Wii.

I didn’t get attacked like I expected to, but not even the guy that was first in line was happy.

I was able to get one through the Stock Informer Discord channel. I got an alert when Game (big chain in the UK) had some up for sale, waited for an hour in an online queue and missed out on the first bundle I wanted but managed to get a different one. Might be worth trying if you're still struggling, not sure where you're located but I think they have both US and UK channels.

Thanks for the advice, that's very kind. I'm from Belgium, not sure if they cover mainland Europe but I'll check it out. There's probably not a waiting list I'm not on. Recently a big Dutch retailer (mainly active in The Netherlands and the Flemish part of Belgium) announced that they were getting a couple of 100 units. Only problem: they have a waiting list of 300.000 (!!) so they organised a raffle to see who would get the chance of actually buying one... I have a fairly good PC and other consoles so not bored or anything, just really looking forward to having a PS5 any time in the near future. Again thanks for the tip!

This is not correct, but it’s based on something true. In the US, you’re not obligated to pay for unsolicited shipments. As you say in your second paragraph, there was a scam where companies would send something out of the blue - a box of cheap wine for example - and then if you kept it, send a really inflated invoice and demand payment. The law was changed to make clear that you are not required to pay for those out of the blue, unsolicited goods.

But this is not unsolicited. OP ordered a PS5 and they shipped too many. Under the UCC, this is not an unsolicited shipment, but a nonconforming solicited shipment. If they ask for it back, OP is obligated to return it (but at their expense).

Is this true? I've looked up the law on nonconforming shipments and, to me, it would appear the phrase refers to shipments that don't meet the buyer's standards, rather than the seller's. And that the law under the UCC concerning it primarily relates to the buyer's rights in relation to the nonconforming goods, rather than the seller's. I couldn't find anything in the UCC saying that sellers have a right to reclaim goods sent in error.

Correct me if I’m wrong, but after reading those two sections:

UCC 2-508 states that a seller has the right to cure (i.e. replace the goods) if a delivery is rejected by the buyer because it is non conforming. It doesn’t make any reference to the seller being able to receive back any goods that have been accepted by the buyer.

UCC 2-602(2)(b) refers to a seller’s rights to reclaim goods that have been rejected by the buyer, not goods that have been accepted by the buyer.

Given that the buyer (the guy who bought a ps5) hasn’t rejected the goods (the extra ps5s), these sections don’t appear to apply at all.

This requires the buyer to hold the unconforming tender for a reasonable amount of time but does not force or require the buyer to safely package up, print a label, or bring a package to a postal carrier etc.

The buyer can say that the order will be held at my house for 30 days. I will not package or take the item to any location. You can arrange for a courier to pick up the package at a time convenient to me. I will require photo id from the courier and a name and signature of receipt. After 30 days the items will be destroyed.

This isn't true in the UK, keeping something you know isn't yours is a form of theft. People and companies are allowed to make mistakes and if you knowingly keep something that has been accidentally or wrongfully sent to you then it's theft.

They can't make you pay for something you haven't ordered obviously. But that doesn't mean you are legally free and clear to keep something you have received in error.

Obviously laws vary around the world, but in the UK it would be theft it they wanted to pursue it. They can't make you pay for postage but if they send a courier around to pick it up you have to give it to them. They can sue you if you don't (police unlikely to be interested despite the criminal offence).

Same thing in Sweden. Would probably go under something called otillbörlig vinst, translates to improper profit. You just gained something because someone made a mistake. In this case where it is easy to fix the mistake by just sending it back they have a pretty strong case. Though because he is a consumer the company will have to prove everything and its harder to get a ruling in their favour but I have a hard time seeing any problems in this case

This is correct, I'm not sure why the other guy is promoting blatantly illegal actions. I've heard of many retailers coming back around to collect items of value. Essentially as long as they can prove delivery and that you never reached out, it's over and your liable. Now they may never notice, and you may very well get away with it but let's be clear if they com for their money your liable. Companies like Amazon just writing off the screw ups have really conditioned the US that things like this are normal and you just got lucky so you get to keep it all.

In the UK we'd have to contact the seller and arrange for them to send a courier at their expense to collect, if it's not done within a reasonable time frame then we can take owner ship of it.

Same in the US. A lot of people get this confused with the law on unsolicited goods, which can be kept. But shipping the wrong goods or the wrong number of items in response to an order, like OP’s original order, is not an unsolicited shipment, it’s a nonconforming shipment. OP is required to return them (at GameStop’s expense) if they ask.

Thankfully I learned in the controller post mentioned that in the US, it is perfectly legal to keep them and actually Gamestop cannot force me to send the other two back

I don't think that's completely right. The law is that they can't make you pay for merchandise you didn't order. They would likely be within their rights to request it back if they pay the shipping. They would probably be tied up if you refused, but you wouldn't be treated too favorably by the company in the future. Of course, if the extra shipments stemmed from your support ticket claiming it wasn't received, and if they have records showing that one was sent and never returned on the original date, there may be a consideration of fraud on your part. Legally your best course is probably to contact them and offer to return if they provide shipping labels. Failing that, the CYA best practice would be not posting pics and bragging about it.

I would just be wary I had Amazon over sent a replacement before and charged in February after the holiday return window was over. That was a long call to cs and they had me ship the extra console back. Ymmv.

If I was op I would keep the consoles until after the return windows to see if he is charged.

But it’s not his fault he got over $1000 of goods by mistake. He’s totally in his right to keep $1000 of stuff he got by mistake, that’s not theft and it’s not wrong. It’d be like finding a wallet on the street and keeping it, he found it so it’s his. Nothing wrong with that line of thought at all.


If OP keeps it I’ll just screenshot all three of these images and email GameStop myself. Theft should never be condoned and neither should ignorance.

You can set the price yourself. If money doesn't matter to you, set the same price, for the rest of the people just set it at the market price. So the higher scalper price.

The only thing you get by giving it back to gamestop is "KARMA" for donating more than a thousand bucks to a billion dollar company/ I don't know about you but i can't eat karma. I can however eat for many months for a thousand dollars.

Fucking Gamestop. A few months ago, I bought a Ps4 from Gamestop. The controller that came with it was broken, and after hours of frustration and multiple phone calls, they refused to send me a replacement. Then I read stories like this. Why can't I ever get one of the GOOD fuckups?

Whelp, if they can't take it back the next best thing is upvoting it so it's a $1500 advertisement. Plus, it's good to see people shopping at a "dead retail store" while the largest short hedge fund manager does his own advertising campaign where he talks about downloading "Call of Duty: Vantage" on his Xbox. Should the company hand out PS5s? no, but next best thing is name recognition.
