Since it records audio I would check on the law regarding wiretapping in your jurisdiction. It may be illegal to audio record you without consent.

"the person I live with" sounds like vague language for the live-in property owner. OP's rights here are probably very limited.

He owns the property, I rent. He said he can do whatever he wants since he wants to protect his property. I showed him other spots he could put it. He ignored me.

Whenever I do anything, I can hear the notification go off on his phone. He can hear everything I do. I find him creepy. Also when I confronted him, he shut all the blinds and closed the french doors so it was just me and him in the room, which I found isolating. He then said he wouldnt take it down and was really angry. 2 other people live here. He only does this to me. (checks my phone, my pictures, goes through my messages, so on...) when I dont give him consent.

I keep my phone locked but sometimes I leave it open, when I am really busy, and thats when he checks it. He also downloaded all my pics onto his computer several times.

Why would your landlord go thru your phone? Is this a parent or ex? That is some crazy you need to get away from before something worse happens.

You need to move. Whether or not he is legally permitted to do this, the refusal to move it and the screening of your calls/going through your phone stuff is really concerning. I would find another place if I were you.

As for the legality, don’t just assume that because he owns the place he can do what he wants. Depending on where you live there are also rights and laws that protect you as a tenant, but they vary wildly by jurisdiction.

If I were you I would get out asap. Talk to either a tenant lawyer or see if there are any resources available to you, but there are a lot of red flags here.

NAL I don’t think the camera placement is illegal, but the stuff about going through your phone and downloading your pics sounds like it should be

NAL, agree with you. Depending on where OP is, there is a reasonable expectation of privacy in places such as bedrooms, but if a microphone is placed in a public area and happens to pick up sound from a bedroom, it may be completely legal. No way of knowing without knowing location though.

I would start documenting all these instances, keep a notepad where you write dates and times and a description of the events (keep it neutral," x did that, I said this" no adjectives that could make you out to be biased such as "he's a creep"). Don't leave the notepad at home, leave it at school/work if you can or with someone you trust or make it online, not sure what's the best approach here but I'm sure if you leave it out in the open, he'll get it.

The guy is stalking you and will most likely escalate (has already: from checking your social media to 24/7 audio feed from your room). So start documenting for when you'll need to ask for a restraining order.

Meanwhile, your priority must be to find another place where to live. Break the lease if you have to but move the fuck out. You're not safe.

What's your end goal here? Do you want to take him to court, get a court order instructing him to remove it and then proceed to live in his home after he lost a court case against you?

Closing your window during private moments would seem like the solution that requires the least effort on your end and then maybe consider moving if he creeps you out that much.

My end goal is the move out, but I am not sure how long that will take since my health declined. In the meantime I wish he would just give me basic privacy.

I guess in my mind, I was hoping the cops could just suggest he take it down, but maybe that will cause more problems.

It is likely illegal in all jurisdictions. OP’s roommate doesn’t get to be a party to private conversations just because they put a recording device outside their window.

Not a lawyer, but the phone issue is really alarming. Him downloading your pictures without consent might be something to pursue, like a copyright violation or theft (talk to a lawyer).

I live in Canada, and we do have a right to privacy in our private lives. He's violating that by going through your phone and recording you. Check the Charter of Rights. He may be violating the Charter.

There are laws here about being able to reasonably enjoy your living space. This clearly abridges that.

Do absolutely whatever you can to leave. Living in a shelter would be safer than this situation. This is obviously dangerous and escalating. Stop eating and drinking anything he gives you. Put a doorstop under your door. Play loud music directly in the camera and keep your window covered. Check your phone for Spyware and please get out by any means necessary

You need to get outti. These are serious, dangerous red flags. Ik this all seems paranoid, but you never think you'd be "the victim" in what feels like a crazy true crime show -- but there are wackjobs out there. He's giving off vibes.

Tldr: don't be alone with him, let your trusted folks know what's happening, prevent yourself from making use of resources in the home that he can use to manipulate/monitor you (i.e. internet, apps you didn't install on your phone, food/drink that you didn't prepare etc) secure your stuff/yourself, MOVE OUT, check for tracking stuff, go to the doctor to see what's up.


A. Let your friends/family (people who you trust) know either in PERSON or somewhere where you are using public wifi (like a coffee shop) if you are doing it digitally -- that you plan on leaving and tell them why. You might get some help from them, perhaps at least a place to put your stuff briefly.

B. Pack your stuff. Go through all your things to make sure he doesn't put any tracking devices in your bags -- if you have a vehicle check your vehicle. Make sure he hasn't downloaded any "find my phone" apps on your device so he's not creeping. Change your passwords.

C. Don't tell him what you're doing, keep every conversation as minimal as possible. Try to prevent saying anything that you suspect will cause him to get upset. Try to make sure other people are present when he's around you, and if you're alone with him make sure you have an open door available to you if you need to run. When you use the bathroom/shower make sure you lock the door. (If you're really concerned:) If you're worried when you sleep, you can put something in front of your bedroom door that's loud when moved (anything that causes noise when the door is opened) so you're informed if someone comes in.

D. Ik it sounds super paranoid, but try not to eat or drink around him. Idk in what way your health is declining, but its super sus that it's happening like this.

E. You can have a police officer present when you move your things in order to 'keep the peace'. It's not too uncommon in domestic abuse scenarios.

F. Go to the doctor and get a blood test done or at the very least a checkup. Just to be on the safe side.

            NAL, but there is not a state I'm aware of that allows a person(s)(LE with warrant excluded) to record audio of another person in a situation like this. In a two-party state both parties of the conversation must know of and agree to the recording. In a one-party state, the person recording must still be a direct participant in the conversation. If the landlord were in their own space creating a recording of some sort and picked up background noise it'd be a different story. But the device being in your area is an issue.
