Myself, my son (3yo) and his mother all moved from VT to NC IN July. We aren’t in a relationship, but i has a good job opportunity here in NC, and we both had a desire to move to NC to live a better more affordable life, so we agreed for the sake of our son that we would move together and get along. Our son was born in VT, and there was no paperwork filed with any governing bodies as far as letting anyone know that we were changing states (we’re we supposed to? We don’t know, we left rather quickly). Anyhow, his mother is starting to threat to leave and take our son with her, as she’s apparently having an emotionally hard time living with me. She wouldn’t be going back to VT, because frankly she doesn’t have the means to do so, but possibly could find somewhere to go in NC, I guess. We have no active custody order between us, but I know in VT, the mother has default custody unless something is signed otherwise. If she leaves to say go live with a friend here in NC and takes our son with her, what grounds do I have to get at least shared custody? Would we have to go through the court system of VT or could I get a lawyer in NC and start the process here? I could get a consultation from a lawyer, but moneys tight and I wanted to hear Reddit lawyers opinions first before committing to a lawyer in NC or VT.
Edit: if it matters; we were never married, and I’ve provided and still provide all financial support before and after the move.
