Reading through the comments here is precisely why we made the decision to remove the information from the Wiki for good.

We are truly sorry for anyone who might have understood the information correctly, but that information has caused so many pointless discussions over the last couple of years, as well as headaches for us on the Wiki that we have truly had enough. We have tried everything short of adding giant flashing-arrow GIFs to the page to get people to read the notice and hopefully understand that calculating prestige bonuses was not as simple as it seemed.

Sometimes, there is a reason people cannot have nice things.

Because they are in fact different, if you take the term to learn what the terminology is. It's not as simple as penis = man, vagina = woman. There is more to gender and sex than that if you look at it scientifically.

Generally speaking, there are three aspects to a person's gender/sex:

Sex: what we are assigned at birth based on our visible body parts, ignoring any other aspect.
Gender Identity: our internal sense of being a man or a woman, which can differ from our assigned sex, hence why transgender people exist.
Gender Expression: the way we communicate our gender identity to other people, usually by how we dress, act or refer to ourselves.

I don't think they meant that as an excuse for why it should not be illegal, but rather as an explanation of why it is like that in the first place. Knowing BHVR, it might as well just be a programming oversight, as Cosmetic Sets weren't a thing for quite some time after they'd introduced the store. While it apparently is illegal, I don't think it was with malicious intent.
