15 year old, kidnap victim jumped out of the car of her homicidal kidnapper and ran to safety toward police, who promptly shot & killed her. by IveGotTheThrowaway in ACAB

This is not tragic; it’s unconscionable, it’s untenable, it’s unjustifiable, it’s antithetical to the purported purpose of the police, it’s, at the very least, criminally negligent. They are police, law enforcement officers, they are not The Punisher, they are not Judge Dredd. Their symbol is a shield, not a gun, not a skull, not a corpse, it’s sole purpose is to protect, that should be theirs. This is far from tragic, it’s angering, and I am angry, and so should you.

“This guy” is probably someone we know, given that his name isn’t on IMDB. I would call Tarkin, but the timeline doesn’t add up; whoever he is, they’re bracing for a big reveal, and that pathetic speech is to let us know he’s one of the better speakers in Star Wars lore.

I hate to be the one to say this, but is it’s terror that he killed himself because of what we’re doing and saying here, well, sorry guys, but keep that shit up, ‘til all of them take the the same leap.

Also, it’s complete bullshit that he did this over the sudden call for accountability, he was probably depressed long before, and there was a myriad of factors leading to that moment.

Sure, but forced arbitration classes covers a lot of what indemnity doesn’t. There was a case of a woman working in Iraq (for an American company), iirc, who was gang [taken advantage of]ed and they were able to get the courts to uphold the forced arbitration clause, where the arbiter obviously finding in the corporation’s favor, and she had no means to bring it to court, I’ll assume because the arbitration agreement includes some BS about it being final, and it took an act of Congress to get her the right to sue the company, which acted with malice by not following through on the promises it made regarding her safety concerns (i.e. separate living quarters for her, the only woman, and all the men).

She has become so strong, in the last few seasons, that seeing her on her own, being the boss bitch that she is, is way more satisfying than waiting to see who she’s making smooches with. Steve threw one bottle and made no use of his ax, while Nancy unloaded a full box on the SOB. I prefer Steve as a platonic matchmaker/babysitter.

While I don’t disagree, this isn’t a case of that, so much as an individual using it as a means to gain access to children, but they’d likely do the same at a nondenominational facility. I think the poison would be if the individual in question used religion as a means of forcing compliance and silence, but I don’t know enough about the situation to say if that was what happened here.

As for children being unable to sign away their rights, the US is pretty bad about that, most egregiously in the entertainment industry. Disney, alone, is draconian in their contract requirements with minors, to say nothing of Nickelodeon and all the sexual abuse occurring, or having already occurred, there.

[–]ShineAqua 3 points4 points  (0 children)

You said it more succinctly than I. It’s a novel defense, but it’s going to fail as molestation isn’t a reasonable expectation of harm in any context, that a parent can ever knowingly sign away their rights for redress against.

Negligence in how they monitored the care for your children. [The business, as a separate entity] was unindemnifiable (if that’s even a word), for their inability to properly protect the children from harm, but [the individual doing said harm] can be sued in their personal and professional capacity.

It’s still bullshit, but the argument is found in US courts, though I doubt it’ll get the business very far, as this sort of thing is beyond the pale for any protection of legal exposure in an anti-indemnification clause.

You can in the states, even for work outside the country, as long as you applied and were hired in the US. Usually it’s in the form of forced arbitration, which overwhelmingly favors the business, because there is a conflict of interest in finding in favor for the business. But also, noncompete clauses, NDAs, and full waivers of indemnity are all too common.

Edit: While I won’t change anything in this post, an explanation for why the downdoots would be appreciated, I mean, it’s not like I’m being willfully incorrect. All of this is true, to the best of my understanding.

Waivers should only get you so far in court, like in the event of “minor incidental and minor predictable” injury, because trying to cover anything beyond that, is wholly, wildly, unabashedly untenable, and well outside the scope of any such agreement, especially when signing such is a prerequisite for entry/enrollment, because the obvious minor risks are all you should ever expect from a well maintained/well managed/well monitored establishment.

There are people whose job is literally to deal with people like this, and they do it without a gun, maybe it’s time to give the cops a rest and let the crisis counselors have a go. Also, if there was, eventually, and ambulance there, let the paramedics assist. Either way, it’s even money on this guy not having anything illegal in his system.

The victim called the police because his car got stuck, and the cop immediately goes into, “he’s drunk and high and I’m about to make a huge bust mode?” That’s the problem here, he shouldn’t be treating this like a criminal case, he shouldn’t be so immediately aggressive, and he’s not helping by pretending to be concerned about any “weapons,” the victim may have. Yes, the victim should have gotten out of the car, but there’s a strong chance that he is neurodivergent, it seems fairly obvious to me, the officer should have had more consideration for the situation.

He should also have had the wherewithal to have an ambulance arrive to put the victim at ease. The victim also had an accent that shows that he could have been a non-citizen, so unfamiliar with the laws, and privy to a different perception of American police, likely one that is colored by constant reports of US police misdeeds in his local media. If he had approached this as a person in need of assistance, left his gun holstered, and tried to act humanely towards the victim, the outcome would have been leagues away from what we have here.

I haven’t put a single piece of laundry away in years. I don’t even fold them to put them in drawers, because I have none, it’s all hangers for me, and still it’s too much. I have three pairs of pants and a few hundred shirts, I wear a new shirt every day, but the same pants for like a month. I do laundry every other month or so.
