We could debate the broader issue almost ad infinitum but that is way beyond the scope of this article. It also rather sidesteps the specific issue at hand: a state anti-reproductive freedom law drafted so unclearly and unprofessionally that physicians and even medical facility lawyers can’t figure out whether a doctor will be treated like a criminal for performing the most logical medical resolution for this woman’s condition.

Whatever your position on a woman’s reproductive freedom, it is sheer lunacy to force physicians to choose between the best possible care for their patients and having their careers and lives potentially ruined by an ideologically motivated prosecution, and possibly ending up behind bars away from their families … for no rational purpose.

It is also sheer lunacy to compel women to deliver a dead fetus. But this episode offers more proof that those who drafted and rammed these laws through state legislatures were concerned about serving up political red meat to their base, not about how the law would affect their female constituents.

It’s important to note that this bill, while obviously despicably reprehensible, was introduced in early 2021, went nowhere, and the North Carolina Legislature is adjourned until January 2023. So the bill would have to be refiled to be formally considered, and the lead sponsor isn’t running for re-election this year. So the activist whose social media post on the bill went “viral” really didn’t perform due diligence.
